Form G-28: what it is, who files it, cost and timing

Notice of Entry of Appearance as Attorney or Accredited Representative

G-28: who files it and when it is needed

Key answer

Form G-28 tells USCIS that an attorney or accredited representative represents you; without it the agency treats the case as if you had no representative. The representative files it together with the form they handle, online from their USCIS account or by mail, and USCIS lists no fee for it. If you file your petition yourself, you do not need a G-28.
  • Signatures are the top reason for rejection. The most common mistake, USCIS says, is a missing signature or missing signatures. Both the client and the representative sign in black or blue ink; a copy, fax or scan of the original signature is fine, a stamp or typed name is not. An improperly completed G-28 is not accepted, and the case proceeds without it.
  • Name and where notices go. Write the client's name exactly as on the related immigration form. When signing, say where notices and secure documents should go: to you or to the representative.
  • Edition and a later G-28. Editions 09/17/18 and 05/23/18 are accepted despite the expiration date printed on them; USCIS says a new one is coming. If a representative joins a pending case, the new G-28 goes to the office handling it or to the return address on the last notice; for some forms it can be filed online. From the knowledge base: How to Check an Attorney's License Through the State Bar

It makes sense to check your attorney's license before making the first payment, not after receiving a strange letter. In the US, attorneys are licensed by individual states, and almost every state keeps a public online registry where you can verify an attorney's status in just a couple of minutes. Below, you'll find how to conduct this check, which document requires your attorney to provide their license in writing, and what to do if the registry provides no information.

For information on how to choose a specialist and whether you even need to hire one, see these separate materials: immigration attorneys and attorney or self-petition. This page only covers verification.

From the knowledge base: Attorney for US O-1/EB-1/EB-2 NIW talent visa: needed?

An attorney for a talent visa will not gather evidence for you or make your achievements look stronger than they are. What the attorney does is package what you have provided, translating it into the language that a USCIS officer understands. So, the question of 'Do you need a lawyer?' is not really about money, but rather about what stage you are at in building your case and how borderline your case is. Below are real prices, data from approved cases, and a process the community considers to be the most advantageous.

G-28: what the chats ask

  • 1×Friends, do you know if a consul in Warsaw says that some documents need to be submitted, can someone else do it with power of attorney, or can only the primary applicant do it?
  • 1×It's currently a bit difficult to obtain a recommendation letter from them, but I will try. Can contracts and powers of attorney substitute for a recommendation letter in this case? Email correspondence.

G-28: community answers

What should I do if USCIS sent an RFE, but the letter never arrived by mail?
You need to contact USCIS urgently and request a copy of the RFE, since the response deadline is usually fixed and runs regardless of whether you actually received the letter. You should also check your online account, the address on file, and, if necessary, involve an attorney or representative.

G-28: rules and tips from the chats

  • tipIf passports or documents need to be delivered to the consulate, one family representative can usually do it with a power of attorney, but the rules depend on the specific consulate and delivery service.
  • tipWhen administrative processing takes a long time, people consider several escalation options: requests through representatives, additional letters, group or individual mandamus, but the outcome is unpredictable.
  • tipIf the case does not move for a long time, people sometimes use letters to the consulate, requests through representatives, or prelitigation tools, but this does not guarantee faster processing and may end up coinciding with the normal completion of review.
  • tipDuring prolonged administrative processing, applicants track bulk releases in their category and at their consulate, and also consider escalation through official inquiries, representatives, or court tools if the wait becomes excessive.
  • tipWhen contacting U.S. senators or representatives, your connection to a specific state matters; if you do not have personal registration in the U.S., you can ask a university, employer, or academic advisor to contact them through their own representatives.
  • tipIt is sometimes possible to give your passport to a courier service by power of attorney if the applicant needs to leave the country; this should be checked in advance based on the rules of the specific consulate and delivery service.
  • tipThere is no standard paid premium processing for I-485. Possible ways to speed it up are an expedite request if there are grounds, or reaching out through a congressional representative, but the result is not guaranteed.
  • common questionPeople often ask whether outside government channels or representatives can be used to respond to an RFE, but that is viewed as an unusual tool that does not replace a well-prepared substantive response to the request.

G-28: the consular stage - rules from the chats

  • After I-140 approval, applicants usually wait for the case to be transferred to NVC and for an instruction letter, but the transfer can take weeks to months.

If a noticeably longer than usual time has passed after approval, a practical step is to check the status with NVC or through a representative, rather than assuming an interview will be scheduled automatically right after approval.

G-28: from community discussions

  • «I understand why lawyers don't want to file the I-140 online. I have no decent words to describe the relationship that has developed with the online account regarding uploading the form and documents. After a day and a half of struggling, the G-28 never uploaded because - oops, the representative's name on the form does not match their records. Mailing it would have taken an hour.»

Irina G. · from public community chats

  • «I read that lawyers file the G28 form with the petition, indicating that they represent us. Since I now represent myself, it seems necessary to indicate this so they can update their records as well. But I have no 100% confirmation of this information.»

Tanya L. · from public community chats

  • «You can file the I-140 and I-485 yourself. If you don't lie there, there shouldn't be any consequences. If the petition is handled by a lawyer, the G-28 is attached. No one expects originals; scans are acceptable.»
