Form I-485: what it is

Form I-485: definition
Key answer
Five steps. (1) An approved or filed petition - an I-140 (EB-1A, EB-2 NIW) or an I-130; when the date is current, the I-485 can be filed together with the I-140. (2) Eligibility to file inside the US: a lawful entry and status at filing - entering on a B1/B2 with intent to stay is considered the main risk, the chats argue about it. (3) The I-485 + I-765 + I-131 packet with the I-693 medical. (4) Biometrics by notice within weeks; the interview is scheduled or waived by category. (5) The decision: approval and the card by mail, an RFE, or waiting for the date if the bulletin retrogressed.
The form edition. USCIS issued a new I-485 edition dated September 18, 2026 (implementing the public-charge rule): for filings submitted on or after that date it is the only accepted edition, there is no grace period, and older editions are rejected. Before filing, download the current form from uscis.gov/i-485 and check the edition date in the page footer; check the fee in the fee calculator - it is not refunded on a denial.
What the wait gives you. While the I-485 is pending, the EAD lets you work for any employer and Advance Parole lets you leave and return; they are often issued as one combined card. A pending I-485 gives a period of authorized stay but is not a status of its own, and the EAD on it lives with the case: if the underlying petition and the I-485 are denied, the right to work can end. Leaving without Advance Parole (and without a separate status such as H-1B that lets you return) can get the application deemed abandoned.
Timelines - community reference points, not official statistics. Biometrics about a month after filing; the median I-485 review sits in the 9-13 month range with a spread from 3 to 18; the EAD in the AOS bundle about 4 months, Advance Parole often around half a year; after approval the card in one case arrived within 10 days. Rely on the current USCIS processing-time tool, not on an old case from the chats.
Typical mistakes and discretion. Filing the I-485 "just in case" without a clear grasp of your status and priority date - mistakes here are the costliest; filing under the wrong bulletin chart (which one USCIS accepts this month is announced on the filing charts page); quitting before the EAD is issued; leaving without parole. Adjustment is a discretionary decision: under USCIS memo PM-602-0199 of May 21, 2026, flawlessly maintained status keeps you eligible but does not by itself earn the grant, so lawyers advise repackaging the petition evidence (the importance of the work, contributions to the US) as positive factors.
AOS or the consulate. The I-485 is the alternative to consular processing through the NVC, the DS-260 and an embassy interview: the same permanent-residence decision, made inside the country. Pros - no embassy trip, an EAD and Advance Parole for the wait; cons - no free travel without parole, timing depends on workload. There is no single answer on which is faster. You can file online or on paper - the comparison is on a separate page.

Form I-485: common questions
- What is the difference between the I-130 and the I-485?
- They are different steps filed by different people. The I-130 is filed by a US citizen or permanent resident to establish the relationship with a foreign relative; per the USCIS form page (checked Oct 5, 2026) filing or approval of the I-130 gives the relative no status by itself. The I-485 is filed by the foreign national inside the US - it is the green-card application once a petition exists and an immigrant visa is available. For immediate relatives of a citizen a visa is always available, so the I-130 and I-485 can be sent together (concurrent filing); others file the I-485 when their Visa Bulletin date is current, or go through consular processing.
I-485: how many cases USCIS handles
Q3 of fiscal year 2026 (April-June 2026): USCIS received 97,501 filings on this line, approved 42,076 and denied 3,160 (93% of decisions were approvals); 268,408 were waiting at the end of the quarter. Half of the completed cases took up to 6 months.
| Line in the report | Received | Approved | Denied | Pending | Median, mo. |
|---|---|---|---|---|---|
| I-485, employment-based | 97,501 | 42,076 | 3,160 | 268,408 | 6 |
Decisions are counted in the quarter they were issued, so some were filed earlier; the line covers every category of the form, not your visa alone. Source: USCIS, Number of Service-wide Forms (xlsx), read 2026-10-11.

«Definitely respond to the RFE: gather up the references, often it's because of incorrect formatting (in the PDFs you need to make hyperlinks at the bottom of each page). The RFE states point by point what and how needs to be fixed, just go through all of it.»

«At my consulate they nitpicked at the fact that in one place we wrote My Device Inc instead of My Device, when it was about the period when the company wasn't registered yet, and they started pressing that we were thereby misleading them. So they really do look even at such small things.»
