Port of entry: what it is

Port of entry: definition

Key answer

A port of entry is the airport or land crossing where a CBP officer decides whether to admit you to the US and in what status. The visa gets you to the border; your status and length of stay are set here, in the I-94 record.

For immigrant-visa holders the first entry is what activates permanent-resident status: after the Immigrant Fee is paid, the green card arrives by mail.

What CBP asks at the border, how to check your I-94 after entry and what to do about errors is covered in the first-entry guide.

Port of entry: the official definition

“Any location in the United States or its territories that is designated as a point of entry for aliens and U.S. citizens. All USCIS district offices and service centers are also considered ports of entry, because they become locations of entry for aliens adjusting to immigrant status.”

  • «Once the case is filed, no evidence obtained after the filing date is accepted for that case. That is, it's reviewed as of the time of filing. The RFE will come for what's already been filed, and they expect a response on what's written there.»

  • «Ask them to send all the documents BEFORE they're sent to USCIS. I had errors in the draft: instead of my receipt number there was a different number and person. They apologized and fixed it without any problem. But ask them to check everything before sending - paralegals can screw up, that's a fact.»
