Form I-129: definition

Key answer

The I-129 (Petition for a Nonimmigrant Worker) is the core form for the O-1 visa. It is filed with USCIS by your employer or agent (not by you), together with the evidence for the criteria and the advisory opinion.

Unlike EB-1A and EB-2 NIW, the O-1 has no self-petition: the I-129 petitioner is an employer or agent and you are the beneficiary. In practice people file through their own company or an agent - covered in a separate article.

Premium processing (I-907) is available for the I-129. After approval you get the I-797 notice and take it to the visa interview (DS-160).

Decisions are counted in the quarter they were issued, so some were filed earlier; the line covers every category of the form, not your visa alone. Source: USCIS, Number of Service-wide Forms (xlsx), read 2026-10-11.
