O-1A: what it is

O-1A: definition
Key answer
O-1A or O-1B. The subtype is dictated by the field, not by profile strength: O-1A covers sciences, education, business and athletics with its own set of 8 criteria (awards, membership, press about you, judging, original contribution, authorship, leading role, high pay); O-1B covers the arts and the film and TV industry with its own set built around creative recognition. The mechanics are shared: an I-129 from an employer or agent, a mandatory advisory opinion, family on O-3; O-1B support crew can come on O-2.
Who petitions. The petitioner is an employer, an agent or your own US company - given a genuine employer-employee relationship; USCIS looks at who controls your work. A mandatory part of the petition is the advisory opinion from a U.S. peer group or labor organization. The visa is granted for specific work with the petitioner. Unlike H-1B, there is no lottery and no annual cap.
The O-1A criteria. Any three of eight: awards for professional achievement; material about you in trade press or major media; your own expert publications; membership in bodies that select by achievement; an original contribution used by others; judging the work of peers as a judge or reviewer; a leading or critical role at organizations with a name; pay well above peers. The wording matches EB-1A (which has 10 criteria, adding exhibitions and commercial success), and so does the practice: three strong criteria beat eight weak ones.
What to expect. The I-129 is eligible for premium processing (15 business days). Over the anonymized O-1 approval stories in the site base, the premium share, the RFE share and the median from filing to approval are computed - the figures are on the O-1 visa page; these are the stories of people who were approved, so they describe the path, not the odds. The fees (I-129, Asylum Program Fee, I-907, the consular fee) are listed there and on uscis.gov.
How it relates to EB-1A and NIW. O-1 is formally a nonimmigrant visa without explicit dual intent, but in practice immigrant intent is treated leniently: filing EB-1A or NIW in parallel usually works out - with careful handling worth discussing with a professional. For many, O-1 becomes a stepping stone: first the visa for the work, then the green card on a record that has grown, since the criteria overlap heavily.
O-1A: the official definition

«Forget about three criteria. These days denials come even with 7 criteria met.»

«Whatever you do, don't do this, I beg you. I tried it, it's a 100% denial. I got a 13-page RFE about how this carries no national importance for the US. Any words about a shortage are a red flag for the officer. They didn't even read my RFE response with the redefined endeavor.»

«Once the case is filed, no evidence obtained after the filing date is accepted for that case. That is, it's reviewed as of the time of filing. The RFE will come for what's already been filed, and they expect a response on what's written there.»
