EB-1A: what it is

EB-1A: definition
Key answer
How it differs from its neighbors. EB-1B (researcher or professor) and EB-1C (multinational manager) are filed by an employer, and EB-2 with an advanced degree runs through PERM; EB-1A has neither - which is why what you prove is not employment but the quality of your own record. O-1 is a nonimmigrant work visa with similar criteria, but it is requested by an employer or an agent; many do O-1 first and EB-1A later on a record that has grown. EB-2 NIW is the other self-petition, judged by a different frame: not acclaim but the national importance of the work under the three Dhanasar prongs.
How it is assessed. Since Kazarian v. USCIS in 2010 the review runs in two steps: first the officer checks formally whether the documents match the description of a criterion, then separately weighs the record as a whole and decides whether sustained national or international acclaim is shown. Hence the frequent outcome: three criteria met, and still a refusal - that is the second step, and it is answered not by adding one more criterion but by a coherent account of recognition (who cites, who invites, who adopts). Three strong criteria are safer than eight weak ones.
The honest numbers. In USCIS data for Form I-140, the denial share of EB-1A decisions rose from 27.8% in fiscal 2024 to 59.3% in the first three quarters of 2026, while the neighboring employer-filed categories stayed inside a 2-6% corridor: what separates them is not the category number but self-petitioning. Over 1,242 AAO decisions, judging and authorship are counted most often, membership and original contribution least often; that is an appeals sample, not a probability of approval.
How the process goes. The I-140 petition (premium processing available: a decision or a request within 15 business days; check the fees on uscis.gov), then visa availability by priority date and country of birth (the Visa Bulletin: EB-1 is often current for most countries, but not always), and then the I-485 inside the US or consular processing through the NVC. Premium speeds up only the petition review, not the queue.
Where petitions are most often lost. Original contribution is argued from the quality of the work, while the criterion asks for consequences outside your own organization; an assertion with no exhibit behind it - a letter saying "widely recognized" proves only the opinion of its author; one discrepancy between documents (dates, titles, figures) lets the officer, under Matter of Ho, re-examine the reliability of everything else; three criteria closed formally with no second step in the petition. The law does not require a lawyer for EB-1A - a visible share of approved petitions are self-filed.
