EB-2 NIW: what it is

EB-2 NIW: definition
Key answer
The three Dhanasar prongs. (1) Your proposed endeavor has substantial merit and national importance - value for the country as a whole, not for one employer; the field can be anything. (2) You are well positioned to advance it: education, skills, track record, progress, a plan, interest from investors, customers or users - specifics, not general words. (3) It benefits the US to waive the job offer and PERM: waiting for an employer and certification is impractical, and the benefit is broader than a single job. All three must be met.
The EB-2 base. An advanced degree (a master or higher, or a bachelor plus 5 years of progressive experience) or exceptional ability - for the latter you meet three of six items: a degree in the field, letters showing ten or more years of experience, a license, pay at an exceptional level, membership in professional associations, recognition of your contribution by peers or the industry. If the diploma is foreign, a credential evaluation helps confirm the degree equivalent - it is not the same as a translation.
How it differs from EB-1A. Both are self-petitioned I-140s with no PERM, but the tests differ: EB-1A asks about you (sustained acclaim, 3 of 10 criteria + final merits), NIW asks about your work (whether it matters to the country). The NIW bar is lower, but there is no criteria list - "write, prove, we will see", as the chats put it - so the case is built as an argument, not as a set of facts. A profile weak for one frame can be strong for the other; nothing forbids filing both.
The queue and timing. The priority date is set when the I-140 is received, and the EB-2 category in the bulletin is row 2nd: it has had visible queues and retrogression, so the bulletin is checked monthly. Premium processing is available but speeds up only the I-140 decision - it does not touch the queue, the NVC or the interview. Then comes the I-485 inside the US (with an EAD and Advance Parole for the wait) or the consular route through the NVC.
Typical mistakes and RFEs. By community experience, requests most often concern prong 2 (that you specifically can advance the endeavor) and national importance; you respond with a coherent narrative and independent evidence, not a resubmission. A weak business plan submitted only in response to an RFE often does not save the case - it is better to show a concrete endeavor and progress upfront. The community usually has 4-8 recommendation letters, and independent ones (from experts who know you by reputation) weigh more. You can test your story against the three prongs with the NIW-check tool.

EB-2 NIW: common questions
- Do I need an employer for EB-2 NIW?
- No. Per the USCIS Policy Manual (Vol. 6, Part F, Ch. 5), a NIW request needs no job offer, and the person may self-petition. The waiver also removes the PERM labor certification, but the petition still includes the employee-specific part of the labor certification form - ETA-9089 or ETA 750B, without DOL approval.
- Who meets the EB-2 base requirement?
- Per 8 CFR 204.5(k): an advanced degree - a US degree above a bachelor or a foreign equivalent; a bachelor plus at least 5 years of progressive experience in the specialty counts as a master. Or exceptional ability: at least three of six types of evidence - a degree in the area, 10 years of experience by employer letters, a license, salary, membership in professional associations, recognition of achievements.
- Can an entrepreneur get EB-2 NIW?
- The Policy Manual treats entrepreneurs separately: merit may lie in business and entrepreneurship, but broad claims about economic benefit and job creation are not enough - you show the importance of your specific endeavor. For the third Dhanasar prong, self-employment that does not adversely affect US workers, or a business that creates US jobs, weighs toward waiving the labor certification.
- How much does an EB-2 NIW filing cost?
- Per the USCIS fee schedule (G-1055, edition 09/09/26, checked Sep 30, 2026): the I-140 is $715 on paper or $665 online plus the $300 Asylum Program Fee for a self-petitioner. Premium processing (I-907) adds an optional $2,965; for NIW the decision comes within 45 business days (USCIS premium processing page, checked Oct 2, 2026).

«O-1 is a talent visa, which includes the understanding that getting it requires a lot of effort. Denials are normal. I get/got rejected by people for whom I did a lot out of friendship.»

«I went to an agency, asked them to help write an article - they made such nonsense. If you publish something like that and the officer reads it, they'll understand that such articles have little to do with the applicant's expert field.»

«Definitely respond to the RFE: gather up the references, often it's because of incorrect formatting (in the PDFs you need to make hyperlinks at the bottom of each page). The RFE states point by point what and how needs to be fixed, just go through all of it.»
