RFIE and RFAE: what it is

RFIE and RFAE: definition

Key answer

An RFIE (Request for Initial Evidence) is a technical USCIS request at the earliest stage: basic checklist documents are missing - passport copy, signature, form page. An RFE asks for evidence on the criteria; a NOID signals intent to deny. None is a denial; the deadline is in the notice, and USCIS must receive the packet by that date.

The three USCIS requests look alike and differ by stage. An RFIE (a technical RFE) comes at the earliest stage and concerns the basic set, not the merits of the case; the guide gives up to 12 weeks as a reference deadline. An RFE comes after the case is taken up on the merits: the officer goes through the criteria and says what is missing for each. A NOID comes when there is enough evidence for a full review but the officer leans toward denial: the deadline is two to three times shorter, and it is answered with argument, not only documents. An RFAE (Request for Additional Evidence) is essentially the same as an RFE.

RFIE or a rejected packet. If the fee is unpaid, signatures or pages are missing, or outdated form editions were used, there will be no request at all: the packet is not accepted and is returned whole with a note of what was missing. That is neither a denial nor an RFIE but a rejection - no case is opened, and no filing date is set. An RFIE comes when the case is already accepted but a basic document is not in it.

How to respond. The same way as to an RFE: one package, strictly by the list in the notice, nothing extra, by the date in the letter - USCIS must receive the response by then, not you mail it. The original notice goes first, then a cover letter in the order of the officer questions, then the exhibits. Do not send documents on your own initiative before a request: a separate parcel may never join the case. The notice comes by paper mail to the address in the petition (Form I-797E), so keep the address current.

Can a second request follow an RFIE. Yes - this is the one case with two requests: a technical RFIE settles whether the packet is complete, not your level, and after the missing document is sent the case moves on as usual, where a substantive RFE on the criteria may come later. After a response to a substantive request there is usually no second one - next comes approval or denial, so a technical request is closed quickly, and a substantive one is prepared as if it were the last attempt.

People in the community often get confused by a "Request for Initial Evidence" on an EB-2 NIW or EB-1A and read it as a denial or as a reason to resend the whole petition. Respond precisely - with the named document. With premium processing the clock pauses while the request is with you and restarts once your response is received. Since August 5, 2026 an officer may deny without an RFE or NOID (policy alert PA-2026-05), so first-time completeness of the packet has become the main protection - including against technical requests.

RFIE and RFAE: common questions

How long do I have to answer an RFIE?
The deadline is in the notice itself, and USCIS must receive the response by that date. The Policy Manual ceiling for evidence requests is 12 weeks (84 days), plus 3 days if the request was mailed; since Aug 5, 2026 the officer sets the specific deadline (PA-2026-05).
What happens if I do not answer an RFIE?
An RFIE is a request for evidence, so the same rule in 8 CFR 103.2(b)(13)(i) applies: the request may be summarily denied as abandoned, denied on the record, or both.
Can I send the response in parts?
It does not help: under 8 CFR 103.2(b)(11) everything requested goes together in one package with the original request, and a partial response counts as a request for a decision on the record.

  • «Then immediately write a request to expedite with a one-page letter. The request should come from the inviting organization, to the Department of State, on why your talk and presence in person are so extremely important. And it's good if they say that a hybrid format is impossible. Additionally you can make a request through a senator/state representative.»
