Artistic exhibitions or showcases: what it means in an RFE or denial

Updated: Author:

Evidence of the display of the alien's work in the field at artistic exhibitions or showcases.
8 CFR 204.5(h)(3) - the text of the criteria

How USCIS checks this criterion

  1. 1«First, USCIS determines whether the work that was displayed is the person's work product.»
  2. 2«Second, USCIS determines whether the venues (virtual or otherwise) where the person's work was displayed were artistic exhibitions or showcases.»

USCIS Policy Manual, Vol. 6, Part F, Ch. 2 (EB-1)

From the knowledge base: Glossary of Terms for U.S. Talent Visas O-1, EB-1, EB-2

This is the layer of terminology that separates people who just read instructions from those who understand the reasoning behind denials. All these terms appear in AAO decisions and in RFE texts, and without knowing them, it is impossible to understand why some cases are denied despite meeting all criteria.

The "Exhibitions" criterion: what a response does with it

6 typical objections across 17 real denials - broken down on the criterion page.

Social media is not probative

Use social media only as supporting confirmation, and make independent sources and organizer documents the foundation.

Evidence: Organizer letter, archived event page, catalog, program, press releases, media coverage, exhibition photos with author and works captioned.

No display of works

Show that the applicant's actual works were publicly exhibited, not just that they participated in the event.

Evidence: Catalog listing the works, captions, floor plan, booth photos, participant list, work submission agreement, curator letter.

The event is not an exhibition

Prove the exhibition format: public display, curatorial selection, venue, dates, audience access.

Evidence: Exhibition description on the venue website, poster, program, curator statement, exhibition photos, attendance data, coverage of the exhibition.

What the officer actually did with this criterion

Across 77 of 259 real notices where this criterion appears, what the officer's own text did with it. In 16% he discussed the evidence that was filed; in 70% the criterion appeared only as recited regulation.

  • engaged with the evidence16% · 12the officer wrote about the specific exhibits, not the criterion in general
  • only recited the criterion70% · 54the regulation text with no discussion of what was filed
  • questioned it4% · 3asked for more without deciding
  • explicitly rejected it4% · 3
  • explicitly accepted it4% · 3
  • noted nothing was filed3% · 2

These are notices - petitions that already drew an RFE, a NOID or a denial - so none of this is an approval rate. It measures attention, not outcome: a criterion the officer usually only recites is one where more exhibits are unlikely to change the reading, and a criterion he argues with in detail is where the response has to do its work.

Cases from the community

unknown · sports · outcome not stated

A coach with a sports background tried to use competitions as evidence under the exhibitions or showcases criterion.

What they did: Submitted sports competitions under the logic of the criterion related to exhibitions, but that approach was not credited; similar achievements were suggested to be tied more strongly to contributions to the field, for example through students' successes.
