Writ of mandamus: what it is

Writ of mandamus: definition

Key answer

A writ of mandamus is a federal lawsuit that compels the agency (USCIS or the State Department) to MAKE a decision on an unreasonably delayed case - but does not force an approval. It is the last rung of the escalation ladder: after a processing-time inquiry, expedite, a congressional inquiry and the USCIS Ombudsman. It needs a lawyer and grounds.

The order of moves for a stuck case: confirm it is outside normal times; an inquiry to USCIS (Case Outside Normal Processing Time) or to the consulate via their form; expedite (USCIS only); a congressional inquiry (representative, then senator); the USCIS Ombudsman (form DHS-7001, not for consular cases); and only then mandamus.

It is used against both USCIS and the State Department for very long delays - including prolonged administrative processing. Community experience is that cases often come back to life after filing, but it is a court step with its own conditions. Be polite, document dates and keep copies.
