Artists and designers have a criterion that does not work in other fields at all - exhibitions. It is among the most under-claimed: people skip it, assuming their shows are too small. It is accepted when both halves are proven: that the work was displayed, and that the event genuinely is an artistic exhibition - catalogue, curator, selection.

  • «A certain level of exhibitions is necessary, along with proof that you actually participated in them. Posters, photographs of works on the wall, catalogs, mentions in the media or other resources. In other words, we submit the event and 3-4 pieces of evidence for each claim. This applies to everything: diplomas, certificates, master classes, facts in recommendation letters, etc. A gallery is not mandatory. I have exhibited in churches, museums, and consulates. The level of the organizers is essential. An artist's income is the most ambiguous parameter. I chose not to mention it.»

What is Adjustment of Status?
Adjustment of Status is the process of obtaining a green card inside the United States without leaving for a consular interview. This path is available only if the requirements related to status, the visa bulletin, and other factors are met.
What is the likelihood of I-485 denial after an approved I-140?
I-140 approval does not guarantee I-485 approval: at this stage, USCIS reviews admissibility, status, violations, criminal history, medical issues, and other factors. If there are no serious problems with the law, status, or documents, the risk is usually lower, but individual circumstances matter.
How much time should I budget for O-1 and EB-1?
For O-1, it is sometimes possible to fit within a few months, especially with expedited preparation and premium processing, but if you factor in the interview and scheduling, it is reasonable to budget about six months. For EB-1, the process is usually longer, and people often plan for a year or more, especially if there is a consular stage or adjustment of status.
How hard is it to get O-1 through a consulate, and should you travel on a tourist visa instead?
O-1 requires an approved petition and readiness to explain the case at the interview; the consular stage can be unpredictable. A tourist visa is not intended for work or an immigration plan, and lack of prior travel may be an additional risk factor, but not the only one.

Myths and reality

Misconception: If a category in the Visa Bulletin appears current or the priority date has become earlier than the listed date, you can automatically file I-485, immediately receive work authorization, or expect a quick interview/green card.

In reality: Current only means that, for the specific category, country of chargeability, and required Visa Bulletin chart, there is currently an opportunity to move forward in the immigration process. For filing I-485 in the United States, it matters which chart USCIS allows for use that month - Dates for Filing or Final Action Dates. Work authorization based on I-485 can be obtained only after a properly filed I-485, not simply after I-140 approval or the priority date becoming current. For consular processing, current does not guarantee an immediate interview: NVC queues, slot availability, and administrative factors still remain.

Myth: Premium processing increases the risk of an RFE, so it is better to file without it.

In reality: Premium processing by itself is not a proven factor that increases the risk of an RFE. It speeds up adjudication, and if there is an RFE, the case usually still moves faster than it would without premium processing.

Myth: If a child is born in the United States while the parent is in tourist status, that alone is an immigration violation and will ruin future O-1/green card processes.

In reality: Birth of a child in the United States is not, by itself, a violation. Risks arise if there were false statements about the purpose of the trip, unpaid medical bills, use of certain public benefits, or other factors affecting good faith and admissibility.
